We may collect:

  • Contact details (name, email, phone number)
  • Enquiry details (message content, site address/postcode, service interests)
  • Business details (company name, job title) where provided
  • Usage data about how the website is used (e.g., pages visited, approximate location, device/browser information) via cookies/analytics
  • Correspondence records (emails, phone notes)

How we collect it

  • When you contact us via forms, email or phone
  • When you request a quote or site visit
  • When you use the website, via cookies and similar technologies (see Cookies section)

Why we use your information (purposes)

We use personal data to:

  • Respond to enquiries and provide quotes/proposals
  • Arrange site visits and deliver services
  • Send service communications (scheduling, changes, aftercare notes)
  • Keep records for admin, insurance, and accounting
  • Improve our website and understand what content is useful (analytics)

The ICO’s “right to be informed” guidance describes the transparency information you should provide and that you should provide it at the time data is collected.

Lawful bases (UK GDPR)

We rely on one or more lawful bases depending on the context, including:

  • Contract (or steps before entering a contract): to respond to requests for quotes and deliver services
  • Legitimate interests: to run our business, keep records, prevent fraud, and improve our services/website
  • Consent: for non-essential cookies/analytics (where required)

The ICO explains lawful bases and that at least one must apply whenever you process personal data.

Cookies and analytics

We use cookies and similar technologies. Some are essential, while others (including analytics) are non-essential.

Under UK rules (PECR), you must tell users about cookies and get consent for non-essential cookies such as analytics.

Google Analytics (GA4): If enabled, GA4 helps us understand website usage (e.g., which pages are visited). Analytics cookies will only be set if you accept them via our cookie banner/settings (where implemented).

Managing cookies

You can:

  • Use our cookie banner/settings (if available) to accept/reject non-essential cookies
  • Control cookies via your browser settings (note: disabling essential cookies may affect site functionality)

Who we share data with

We may share personal data with:

  • Service providers who support our website and email hosting
  • Analytics provider(s) (e.g., Google) if you consent to analytics cookies
  • Professional advisers (e.g., accountant) where necessary
  • Insurers or legal advisers if required for claims or disputes
  • Authorities where required by law

We do not sell personal data.

How long we keep data

We keep personal data only as long as needed:

  • Enquiries/quotes: typically up to 12–24 months after last contact
  • Clients and invoices: typically 6 years (accounting/tax recordkeeping)
  • Analytics data: per our analytics configuration and cookie consent settings

Your rights

You may have rights to:

  • Access your personal data
  • Correct inaccurate data
  • Request deletion (in some cases)
  • Object to processing based on legitimate interests
  • Restrict processing (in some cases)
  • Data portability (in some cases)
  • Withdraw consent (where we rely on consent)

The ICO sets out what privacy information must be provided and supports these transparency rights.

Complaints

If you’re unhappy with how we handle personal data, please contact us first at roth.horticulture@outlook.com.

You also have the right to complain to the UK supervisory authority, the Information Commissioner’s Office (ICO). The ICO notes it’s good practice to tell people they can complain to the ICO.

Security

We take reasonable technical and organisational measures to protect personal data. However, no website transmission is completely secure.

Changes to this policy

We may update this policy from time to time. The “Last updated” date will change accordingly.

1. Who we are

Roth Horticulture Ltd (“we/us”). Registered office: 12 Wallflower Lane, Great Somerford, Chippenham, Wiltshire, SN15 5FF.
Email: roth.horticulture@outlook.com

2. Quotes, proposals and scope

  • Quotes/proposals are based on the information available at the time (site visit, photos, access, specification).
  • Work scope will be confirmed in writing (proposal, email, or agreed programme).
  • Any additional work outside the agreed scope will be quoted/approved before proceeding, where practicable.

3. Scheduling and access

  • You agree to provide safe and reasonable access to the site at the agreed times.
  • If access is not available, we may charge a reasonable call-out fee or rescheduling cost.

4. Client responsibilities (site conditions)

You are responsible for:

  • Marking/identifying hidden services where relevant (irrigation lines, cables, drains) and known hazards
  • Ensuring pets are controlled and working areas are clear
  • Obtaining permissions where required (e.g., landlord approvals)

5. Cancellations and rescheduling

  • Please give as much notice as possible.
  • For short-notice cancellation (e.g., within 48 hours), we may charge a reasonable fee to cover allocated time/labour, unless cancellation is due to severe weather or safety concerns.

6. Weather and seasonal constraints

Horticultural work can be weather-dependent. For safety and quality, we may reschedule during extreme weather, saturated ground conditions, or when timing would risk plant health.

7. Waste and removals

Unless stated otherwise:

  • Green waste removal is included only if specified in your proposal/programme.
  • Where removal is included, we dispose of waste responsibly.

8. Invoices and payment

  • Payment terms are as stated on the invoice (e.g., 7/14/30 days).
  • Late payments may result in pausing scheduled work until the account is up to date.

9. Standards and outcomes

We aim for consistently tidy, professional results. Horticultural outcomes can vary due to soil, weather, pests/disease, previous maintenance and seasonal timing.

10. Liability and insurance

  • We will take reasonable care and hold appropriate insurance for our services.
  • We are not responsible for pre-existing defects or issues (e.g., unstable structures, concealed damage) unless caused by our negligence.
  • Nothing in these terms limits liability where it cannot be excluded under law. UK Government guidance notes that terms which unfairly remove statutory rights are likely to be unfair.

11. Complaints

If something isn’t right, please contact us promptly so we can inspect and resolve it.

12. Governing law

These terms are governed by the laws of England and Wales.
